This Privacy Policy explains how InGen AI Company, LLC ("InGen," "we," "us," or "our") collects, uses, and protects information when you visit ingenai.co (the "Site"), contact us, subscribe to our briefs, or become a client and pay us for services. Some InGen products have their own policies (for example, InGen Marketing at ingenmarketing.com and InGen Publishing at ingenpublishing.com). Where a product has its own policy, that policy governs your use of that product.
1. Information we collect
Information you give us
- Contact and inquiry details. Your name, email address, phone number, company name, and anything you write to us when you email us, start a build, or request information.
- Newsletter sign-ups. Your email address (and name, if provided) when you subscribe to our AI Briefs or other updates.
- Client and billing details. When you become a client, we collect the business and contact information needed to deliver services and send invoices, such as legal business name, billing address, and billing contact.
- Payment information. When you pay by card or by ACH bank debit, you provide payment details such as card number, expiration date, security code, billing ZIP code, bank name, routing number, and account number. See Section 3 for how payment information is handled.
Information collected automatically
- Server logs. Like most websites, our servers record basic technical information for each request, such as IP address, browser type, the page requested, and the date and time. We use this to keep the Site secure and running.
- Cookies. The Site does not use advertising cookies or cross-site tracking. We do not run third-party advertising pixels on ingenai.co.
2. How we use information
- To respond to your inquiries and provide proposals, contracts, and services you request.
- To send invoices, process payments, issue receipts, and keep accounting and tax records.
- To send our briefs and updates if you subscribed. Every email includes an unsubscribe link.
- To secure, maintain, and improve the Site and our services, and to prevent fraud.
- To comply with legal obligations and enforce our agreements.
We do not sell your personal information, and we do not share it with third parties for their own marketing.
3. Payments, cards, and ACH
We accept payment by credit card, debit card, and ACH bank transfer through Clover, a payment platform provided by Fiserv and offered through our bank. When you pay:
- Card and bank account details are entered into and processed by Clover's secure, PCI DSS compliant systems. InGen does not store full card numbers or card security codes on our own systems.
- We may keep limited payment records, such as the payment amount, date, payment method type, the last four digits of a card or account, and authorization records, to reconcile invoices, answer billing questions, and meet legal and accounting requirements.
- For ACH payments, we keep a copy of your authorization for as long as required by the Nacha Operating Rules (currently two years after the authorization ends).
- Clover and its banking partners process your payment information under their own privacy policies and applicable financial privacy laws.
4. When we share information
We share information only as needed to run our business:
- Service providers that work on our behalf, such as our payment processor (Clover / Fiserv) and bank, email and newsletter delivery providers, website hosting and infrastructure providers, and professional advisors such as accountants and attorneys. They may use your information only to provide services to us.
- Legal reasons, when required by law, subpoena, or court order, or to protect the rights, property, or safety of InGen, our clients, or others.
- Business transfers, if InGen or one of its business lines is involved in a merger, acquisition, or sale of assets, in which case information may transfer as part of that transaction.
5. AI services and client data
InGen builds AI operating systems for clients. Data a client provides for a build or a service is used only to deliver that client's services, is kept separate from other clients' data, and is not used to train AI models for other clients. Where AI model providers process data on our behalf, we use their business or API services, which do not use submitted data to train their public models under their terms. The specific handling of client operational data is set out in each client's signed agreement, which controls if it differs from this policy.
6. Data retention
We keep information for as long as needed for the purposes above. Inquiry and newsletter information is kept until you ask us to delete it or unsubscribe. Billing, payment, and tax records are kept for as long as required by law (generally up to seven years).
7. Security
We use reasonable administrative, technical, and physical safeguards, including encrypted connections (HTTPS) across the Site, access controls, and encrypted backups. No system is perfectly secure, so we cannot guarantee absolute security.
8. Your choices and rights
- Email: unsubscribe at any time using the link in any email, or by contacting us.
- Access, correction, deletion: you may ask us to tell you what personal information we hold about you, correct it, or delete it, subject to records we must keep by law (such as payment and tax records).
- Depending on where you live, you may have additional rights under state privacy laws. Contact us and we will honor requests as required by applicable law.
9. Children
The Site and our services are intended for businesses and adults. We do not knowingly collect personal information from children under 13.
10. Changes to this policy
We may update this policy from time to time. The "Last updated" date at the top shows when it last changed. Material changes will be posted on this page.
